CBD and Driving: What You Need to Know About THC Limits

Cannabidiol is not intoxicating – nevertheless, CBD and driving is a legitimate question. After all, it is not CBD that is checked, but THC. Here you can find out what applies legally and what you should look out for in practice.

Note: This post is general information and not legal advice. If in doubt, consult a lawyer.

What a roadside check is about

Police preliminary tests and blood analyses look for THC or its breakdown products, not for cannabidiol. CBD itself is not on any list of impairing substances. The matter becomes relevant because full spectrum products made from industrial hemp may contain traces of THC as a result of the production process.

    Austria

The Austrian Kraftfahrgesetz does not have a fixed nanogram limit as there is for alcohol. What matters is fitness to drive: anyone impaired by narcotic substances must not drive (§ 5 Abs. 1 StVO). The procedure consists of a preliminary test, a clinical examination by a public health officer and, if necessary, a blood sample. A mere trace of THC without impairment is something different from a demonstrable unfitness to drive – but the assessment is not up to you.

    Germany

In Germany, since the 2024 amendment, a statutory limit of 3.5 ng/ml THC in blood serum applies; above this, fine proceedings under § 24a StVG may follow. For novice drivers in their probationary period and for under-21s, there is also a ban on cannabis at the wheel. If signs of impairment are added, the stricter § 316 StGB applies regardless of the measured value.

Can a CBD product trigger these values?

With normal use of a product that complies with its declaration, this is unlikely but not impossible. Studies show that the cumulative intake of THC traces from full spectrum products at high doses can produce measurable blood levels (Lachenmeier & Diel, 2019). Three points in particular are critical:

    • High daily amounts of full spectrum oils over a long period.
    • Products without a certificate of analysis, whose THC content nobody knows.
    • Confusion with intoxicants – such as HHC or THC-like products, which are not to be equated with CBD.

    CBD and driving: practical precautions

    1. Only use products with a certificate of analysis and know the stated THC content.
    2. Do not take an unusually high amount before longer journeys; test new products on a day off first.
    3. If you feel tired or unfocused: do not drive – this applies regardless of the product.
    4. Anyone who drives for work or is tested regularly tends to opt for broad spectrum or isolate products, such as our CBD crystals.
    5. Carry proof with you: an invoice or label with the declaration helps if questions arise.

We explain in detail why tests can be triggered despite cannabidiol under CBD and drug tests.
